Terms & Conditions

Please read these terms and conditions (Terms of Use) carefully before using this Application (the "App"). Using this App indicates that you accept these terms and conditions. If you do not accept these terms and conditions, do not use this App. We may change our terms and conditions from time to time so you should review them regularly. Your use of this App will be deemed an acceptance of the terms and conditions existing at that time.

This App is operated by KODIME Ltd on behalf of The Orchestra Marketing Consortium ("Consortium"). The Partners that make up The Orchestra Marketing Consortium include the London Symphony Orchestra, Britten Sinfonia, Barbican, London Philharmonic Orchestra and more. By agreeing to these Terms of Use and setting up an Account with the Consortium you agree that you are over the age of 18 and that you are currently an under-graduate or post-graduate student. You and your guests will be required to carry valid student ID to all concerts you attend. You agree to use your best endeavours to ensure that no other person can access your Account, and agree to be held solely responsible for any activity that takes place within your Account.

Loyalty Points

Loyalty Points are awarded for ticket purchases by you for yourself and for your friends. Loyalty Points are only awarded for actions completed through the App. Loyalty Points can be used to claim rewards as set out in the App. Loyalty Points have no cash equivalent. For more details of how to earn and spend Loyalty Points, please see the information tab in the App. The Consortium may, at its sole discretion, amend these details from time-to-time.

Limits of use

The Consortium reserves the right, in our absolute discretion, to terminate your access to the ticket buying section of the App services with or without notice. While Consortium endeavours to ensure the App is available 24 hours a day, Consortium shall not be liable if for any reason the App is unavailable at any time, for any period.

The content of the App is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of the App on appropriate hardware for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the App without written permission from the Consortium.

Privacy

The Consortium will be data controller in relation to any personal data which you provide to us via the App. The Consortium will use this personal data in accordance with its Privacy Policy, found here.

Conditions of Sale

Tickets purchased via the app are non-refundable.

Only tickets purchased from the app are valid for admission. Tickets sold via unauthorised third parties, including online auction sites, are not valid for entry. Reselling a ticket for profit or commercial gain makes it void and the ticketholder may be refused entry.

Tickets allocated are random and there is a chance that groups cannot be seated together.

Refunds

Tickets will not be refunded unless a performance is cancelled or abandoned when less than half the performance has taken place.

Arriving late

To limit disturbance to fellow audience members and artists we may have to ask you to wait until a suitable break in the performance. Occasionally this may not be possible once the performance has started.

Conditions of entry

No member of the audience will be permitted to sit in any gangway which intersects or flanks the seating.

The taking of photographs, capturing of images or the use of any recording devices including mobile phones during any performance is strictly prohibited.

The Consortium Partners reserve the right to:

  • refuse admission to the premises and venue
  • request any ticket holder to leave the venue, and take appropriate action to enforce this right
  • change the advertised arrangements of any performance in the event of illness or any cause beyond their control.

Other legal terms

You agree to indemnify and hold the Consortium Partners harmless from all liabilities, claims and expenses that arise out of the content you submit, post or transmit via the App or the use/misuse by any person for whom you are responsible or from your violation of these Terms of Use.

The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. The construction, validity and performance of these Terms of Use and all non-contractual obligations arising from or connected with these Terms of Use, the Privacy Policy, and any Consortium Partner website policies shall be governed by English law. Any action or proceeding brought to adjudicate any dispute related to these Terms of Use, the Privacy Policy or any Consortium Partner website policies shall be subject to the exclusive jurisdiction of the English courts or, if you are a consumer, the courts of the jurisdiction where you usually reside.
